Most damages in personal injury cases are classified as compensatory damages. These damages are intended to compensate injured victims for what was lost because of the accident or injury. From a monetary perspective, the main objective of compensatory damages is to make victims whole again. Simply stated, compensatory damages place a dollar figure on the consequences of an accident.
Here is a list of the reasons why compensatory damages are awarded in personal injury cases:
Victims may recover the costs of medical care associated with the accident. These may include reimbursement for treatment already received and compensation for estimated costs of future medical care.
Property loss damages are awarded to victims for repair of or compensation for properties that were lost or damaged, such as vehicles, clothing or other items.
Loss of income:
Victims may be entitled to compensation if accidents impact their income. These include income that has already been lost, and income that victims would have been able to make in the future. The award for damages based on future income is characterized as compensation for the victims’ “loss of earning capacity.”
Pain and suffering:
These damages are awarded to victims for the pain and suffering experienced during an accident and in its immediate aftermath.
Loss of enjoyment:
Victims may be entitled to receive “loss of enjoyment” damages when the injuries they have sustained keep them from enjoying day-to-day pursuits such as hobbies, exercising and other recreational activities.
Loss of consortium:
Loss of consortium damages are granted to victims for loss of a relationship with their spouses, such as the loss of companionship or the inability to maintain a sexual relationship. Some states award loss of consortium damages directly to affected family members rather than to the victims.
Emotional distress damages are awarded to personal injury victims for the psychological impact of injuries such as fear, anxiety and sleep loss.
