Who are eligible for the Stryker hip settlement?
The Stryker hip settlement is applicable to the patients who suffered injuries due to the implantation of either Stryker Rejuvenate or ABG II and need to undergo surgery to remove or replace that device. The settlement program is also applicable to certain patients who are too sick or medically unstable to undergo the necessary revision surgery.
What if you have a Stryker device but don’t meet all three qualifications?
The legal rights and claims of the people who are not eligible for the Stryker hip settlement are not affected by the settlement program. If you fall under this category, we are here to help you. Contact us.
Is there a base award for those who participate in this settlement?
The settlement program includes a base award amount of $300,000 to each victim who has undergone revision surgery on or before November 2, 2014. Age, prior hip revisions and other relevant factors will affect the settlement. In addition, there will be a process in place that may increase the award based on certain procedures or complications as a result of the revision surgery, referred to as “Enhancements” in the Settlement Agreement. Eligibility for the base award and any “Enhancement” will be determined at separate times. Finally, there may be future “Enhancements” a claimant is entitled to if the claimant has further procedures involving their Stryker hip implant within two years of the last surgical procedure.
Will my award be reduced for coverage I received from my insurance company?
According to law, when a person receives compensation for injuries that required medical care, either through a trial or a settlement, the person who paid those medical expenses may have a right under the law to be reimbursed for certain expenses they paid for. In other words, you may be responsible to reimburse Medicare, Medicaid, or other government entities and possibly your private health insurance provider as well.
